1. Acceptance of Terms

By downloading, installing, accessing, or using the SideQuest mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SideQuest ("Company," "we," "our," or "us").

2. Description of Service

SideQuest is a social challenge mobile application that enables users to:

Create and participate in group challenges ("SideQuests")
Share photos and videos as challenge submissions
Vote on other users' submissions within groups
Communicate through group chat features
Track scoring and participate in leaderboards
Receive push notifications about app activities

The Service is provided on an "as-is" and "as-available" basis, and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account by providing:

A valid email address
A unique username
A secure password
Optional profile information (name, bio, profile picture)

3.2 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

You must be at least 13 years old to create an account. Users under 18 must have parental consent to use the Service.

All user-generated content must:

Comply with applicable laws and regulations
Respect others' rights and dignity
Be appropriate for a general audience
Not contain harmful, offensive, or illegal material
Be original or properly licensed for your use

5.3 Content Moderation

We reserve the right to:

Remove content that violates these Terms
Suspend or terminate accounts for violations

5.4 Content Backup and Loss

You are responsible for maintaining backups of your content. We are not liable for any loss or corruption of user-generated content.

6. Content Ownership and Licensing

You retain ownership of the intellectual property rights in content you create and share through the Service.

By sharing content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

These licenses terminate when you delete your content or close your account, except for content that has been shared with others or is necessary for Service operation.

7. Privacy and Data Protection

By using the Service, you consent to:

Vote manipulation or gaming is prohibited
Scoring algorithms may be updated to improve fairness

8.3 Leaderboards and Scoring

Points are awarded based on community voting
Leaderboards are group-specific with separate point tracking
Scoring profiles track user achievements and statistics
We reserve the right to adjust scores for violations or errors

9. Group Features and Challenges

9.1 Group Creation and Management

Users may create and manage groups for:

Organizing challenges and activities
Facilitating group communication
Managing member participation
Setting group-specific rules and preferences

9.2 Group Membership

Group creators have administrative privileges
Members must follow group-specific rules
Participation in group challenges is voluntary
Members may leave groups at any time

9.3 Challenge Participation

Challenges may have specific rules and requirements
Submissions must comply with challenge guidelines
Time-locked submissions create anticipation and engagement
Challenge results are determined by group voting

10. Push Notifications

10.1 Notification Types

We may send push notifications for:

Challenge updates and reminders
Group activity and messages
Voting results and scoring updates
Important service announcements

10.2 Notification Preferences

You can:

Manage notification settings in your account
Opt out of specific notification types
Disable notifications entirely through device settings
Update preferences at any time

10.3 Notification Delivery

Notifications are delivered through Firebase Cloud Messaging (Android) and Apple Push Notification Service (iOS)
Delivery depends on device connectivity and settings
We are not responsible for failed or delayed notifications

11. Service Availability and Limitations

11.1 Service Availability

The Service is provided on an "as-is" and "as-available" basis
We do not guarantee uninterrupted or error-free operation
Maintenance and updates may temporarily affect availability
Service features may be modified or discontinued at any time

11.2 Technical Limitations

Service performance depends on device capabilities and network connectivity

14. Account Termination

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
